Can a small company which is not subject to restrictions under Sec 139(2) of CA 2013, appoint statutory auditor for a period less than 5 years in AGM?

Every Company has to appoint statutory auditor till the conclusion of every sixth meeting except those companies who falls under sub-section (2) of Section 139 of the Companies Act, 2013.
