A Chief Executive Officer of the Company can be designated as Key Managerial Personnel under Section 203 of Companies Act, 2013 if he is appointment before the commencement of Companies Act, 2013?

Yes, every listed Company and prescribed class of companies shall required to designate the Chief Executive Officer as Key Managerial Personnel and file a return of it in form MR-1 with Registrar in order to inform. In case of fresh appointment CEO /any KMPs Company is required to comply with the provision of Section 203, 196 Schedule V of CA 2013.
